Acceptance of Terms

By accessing and using the Polygon Digital website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

Polygon Digital provides websites and related digital services on a monthly subscription basis. The core Website plan covers design, hosting, SSL, ongoing edits, and access to the Core client portal. Optional add-on services, such as SEO and ads management, are billed monthly alongside the Website plan and can be added or removed as you go. Custom projects (such as online stores or web applications) are scoped and quoted separately before any work begins.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information needed to build and maintain your website
• Respond to requests for feedback, approvals, or content in a timely manner
• Ensure you have the rights to any materials you provide for use on your website or in your campaigns
• Keep your monthly subscription payments current

Billing and Payment

Subscriptions are billed monthly in advance. There is no setup fee, no deposit, and no long-term contract. Unless otherwise agreed in writing:

• Your subscription renews automatically each month until you cancel
• Advertising budgets for ad campaigns are paid by you directly to the advertising platform (such as Google or Meta) and are separate from our management fee
• If a payment fails and is not resolved after reasonable notice, we may pause services until the account is current
• Separately quoted custom projects follow the payment schedule set out in their written quote

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will not be billed again after that. There is no cancellation fee and no notice period required.

Intellectual Property and Ownership

Your domain name is registered in your name and remains yours at all times. If you cancel, you keep your site and your domain: we will provide an export of your website content and design and cooperate in transferring your domain's DNS to a provider of your choice. We retain ownership of:

• Our pre-existing tools, frameworks, and methodologies
• Generic code or components that may be reused across client sites
• Portfolio rights to showcase work we have built (unless otherwise agreed)

Limitation of Liability

Polygon Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

No Guarantees

While we strive to deliver excellent results, we cannot guarantee specific outcomes such as search engine rankings, traffic numbers, or conversion rates. Results depend on many factors outside our control.

Governing Law

These Terms of Service shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
